Home Instead is a network of Home Instead® franchise businesses and master franchise businesses that are independently owned and operated ("Network"). Home Instead, Inc. ("We, Us, Our") is the franchisor of the Home Instead Network.

Scope of Policy

This Privacy Policy covers data collected through Home Instead, Inc.'s digital properties on which this Privacy Policy is linked or applications we make available on third-party sites or platforms ("Site"). This privacy policy generally does not apply to data controlled and processed by independently owned and operated Network franchisees. Any client health data, or data subject to the Health Insurance Portability and Privacy Act (HIPAA) and its implementing regulations, must be requested directly from the appropriate franchise office.

However, for the purposes of California Resident data collected under the California Consumer Protection Act (CCPA) only, this privacy policy applies to personal data collected online or offline either: by Home Instead, Inc.; or by the Network and for which Home Instead, Inc. jointly determines the purposes and means of processing.

Policy Changes

This Privacy Policy is subject to change. If we make any material changes, we will notify you, by means of a notice on the Site. Where required by applicable law, we will obtain your consent. We encourage you to review this Privacy Policy periodically and to make note of the date of the most recent revision. By using our Site, you agree to the terms of the Privacy Policy in effect at that time and as may be updated from time to time. If you are a California resident, then by communicating or doing business with us, online or offline, you agree to the terms of the Privacy Policy in effect at that time and as may be updated from time to time.

We collect Personal Information and Anonymous Information as described below. Franchisees may also collect this information, to which Home Instead, Inc. may have access solely for the purpose of maintaining its franchise systems, marketing, brand standards, and other franchisor activities.

Personal Information

This is information collected that identifies (whether directly or indirectly) a particular individual. Personal information includes, but is not limited to, the types of personal information listed below (with examples):

• Names. first name, last name, username, preferred name, maiden name, initials, signature, job title, social media account name
• Location. street address, postal code, telephone number, IP address, device ID, email address, and location information from website visitors and app users. This may include precise location information.
• Dates. date of birth, date of hire, date of services received, date of services provided, date of death.
• Health & Physical Characteristics. Medical Conditions, diagnosis, care needs, hours of care, age, gender, medical provider recommendations physician or healthcare professional practice specialty, heart rate, health symptoms, height, weight, medication, blood pressure, diagnosis, care records
• Profile. Information regarding family, friends, relationships, habits, behaviors, attitudes, preferences, opinions, feedback, living environment and conditions, service and customer service records, and inferences made from this data
• Financial Information/Insurance. insurance payor sources and benefits information, private payment sources and benefits information, government payment sources and benefits information (Medicaid, Veteran's Benefits, etc.), payment records
• Employment Data. applications, (which include information such as education and employment history), background check results, and employee records including performance and benefits administration data.
• Online Activity. We collect logs and session data when you visit our website or use our applications. We collect browser and operating system information. We collect what site you came from or what site you visit when you leave us. We collect your IP address. We also collect device identifiers.

Anonymous Information

This is information collected that does not directly or indirectly identify an individual and cannot reasonably be used to identify an individual. We may use or share Anonymous Information without special limitations, including sharing with third parties.

Aggregate Information

This is information created about groups or categories of individuals from Personal Information and Anonymous Information that does not identify, and cannot reasonably be used to identify, an individual. We may use or share Aggregate Information without special limitations, including sharing with third parties. For example, we may share with a third-party providing research services that, in turn, will help to enhance the experiences of the Network's clients or CAREGiversSM. Such third parties may publish the results of these research findings.

Data Sources and Interaction With UsSite Registrations/Form Submissions/Accounts

If you choose to register or create an account on our Site, you will be asked to provide Personal Information which may include your name, mailing address, e-mail address, and phone number. We do require that you register and provide certain Personal Information in order to send us electronic inquiries, or to receive educational information via newsletters. Except as otherwise provided in this Privacy Policy, we do not actively share Personal Information gathered from our web servers. When you register, we will place your name in our mailing list and will send you an e-mail to the address you have provided to confirm your registration on our Site .

Web Usage

As is true of most websites, we gather certain information about your site and web usage, patterns and location . Technologies such as cookies, beacons, tags and scripts are used by Home Instead and our affiliates, our marketing, testing and quality assurance partners, and/or our analytics, information technology and web monitoring service providers. We may receive reports based on the use of these technologies by these companies that contain personal information, aggregate information, or anonymous information. Click-to-Chat Conversations

Any personal information that you share during any click-to-chat conversation will be considered Personal Information that may be used and retained in accordance with this Privacy Policy. As a click-to-chat conversation may not be a secure form of communication, please do not provide any social security numbers, credit card numbers, or other sensitive information during any click-to-chat conversation in which you elect to participate.

Third Party Websites

Occasionally our Site may include a hyperlink or embedded link ("Link") or a banner advertisement ("Banner Ad") containing a Link which allows you to connect to the home page of a third party website ("Third Party Site"), the independent website of a Franchisee ("Franchisee Site") or the website of a Master Franchisee ("Master Franchisee Site")(such as a US Franchisee website not using "homeinstead.com"). Home Instead or the Network may provide these Links to you as a convenient method of accessing information that may be useful or of interest to you. This Privacy Policy and the practices that we follow under this Privacy Policy do not apply to Third Party Sites, Franchisee Sites or Master Franchisee Sites that are operated independently from Home Instead.

We are not responsible for the content, accuracy, or opinions expressed on any Franchisee Site, Master Franchisee Site or Third Party Site or for the privacy practices of our Franchisees and Master Franchisees or any third party. We will not, and are under no obligation to, investigate, monitor or check the Franchisee Sites, Master Franchisee Sites or Third Party Sites for accuracy or completeness, or for any obscene, scandalous, inflammatory, pornographic, indecent, profane, defamatory or unlawful content or materials. Inclusion of any Link or Banner Ad to a Third Party Site, or Franchisee Site or Master Franchisee Site that is placed on our Site does not imply approval or endorsement of the Third Party Site, Franchisee Site or Master Franchisee Site. You understand and agree that by clicking on a Link to a Third Party Site, Franchisee Site, or Master Franchisee Site you have left the Site, and the Home Instead Privacy Policy stated on the Site is no longer in effect.

Social Media

Any information, including personal information, that you choose to share in any online message board, forum, or via social medial is by design open to the public and not private. You should think carefully before posting any personal information via social media. What you post can be seen, disclosed to or collected by third parties and may be used by others in ways we cannot control or predict, including to contact you for unauthorized purposes. As with any social media or public forum, the information you post may show up in third-party search engines.

We may collect Personal Information from social media sites and services when you use your social media account to log into this Site or use the Site to take other actions on social media, such as sharing.

Social Media Sharing

Our Site includes social media sharing tools and features, such as Facebook Like, YouTube, Twitter and "share" buttons and widgets, and interactive mini programs that run on our Site (each a "Feature" and, collectively, the "Features"). These Features may collect your IP address and which page you are visiting on our Site and set a cookie to enable the Feature to function properly. Features and widgets are either hosted by a third party or hosted directly on our Site.

Social Media Message Boards and Public Forums

Social medial message boards and public forums provide users with similar interests and concerns a place to share information and support one another, post questions, or enter into moderated online discussions. We maintain profiles or accounts with various third-party social media providers, including, Facebook, Twitter, Instagram, LinkedIn, YouTube, and Google+ and may also provide our own message boards and forums utilizing the services of a third-party, including the Your Caregiver Guide public forum. Your interactions with these Social Media Properties and/or the Features are governed by multiple privacy policies. While our collection, use, and disclosure of information obtained through the Social Media Properties and/or the Features is governed by this Privacy Policy to the same extent as information gathered through the Site, the information third-party social media providers collect or access through your use of the Social Media Properties is governed by such third-party's privacy policy. We encourage you to review the social media provider's privacy policy before interacting with a Social Media Property and/or Feature.

Referrals

If you choose to use our referral service to email a friend about the Site, we will ask you for your name, email address and your friend's email address. We will automatically send your friend a one-time email inviting him or her to visit the Site and may use your friend's email address in accordance with this Privacy Policy.

Your friend may contact us using the Data Privacy Request Form to request that we remove their information from our database.

Hilarity for Charity® Respite Care Grant Applications

If you apply for a Hilarity for Charity® respite care grant via our Help for Alzheimer's Families Site, any personal information that is included in the application that your submit via the Site will be considered Personal Information that may be used and retained in accordance with this Privacy Policy. In addition, we will share this Personal Information with the Hilarity for Charity® review board for its consideration of your application and, if you are awarded a respite care grant, the Franchisee that may provide such respite care. We will also store this Personal Information for purposes of responding to any inquiries you may have about your application after it is submitted.

Missing Senior Network

The Missing Senior Network collects personal information and anonymous information regarding users, their contacts, and the subject of any alerts. Such information will be used provide users the Missing Senior Network services ((i.e., issuing alerts to users' designated contacts in an effort to enable users to quickly locate their missing loved ones who have Alzheimer's disease or another form of dementia).

If you create an account with Missing Senior Network or are added as a network contact and choose not to opt-out, then any personal contact information that is submitted in the to the Site may be used and retained in accordance with this Privacy Policy.

Users may issue alerts via the Website and via any social networking service made available via the Website. The alerts are, by design, not private and users represent and warrant that they are authorized to share such information, in accordance with the website's Terms of Service. What you post can be seen, disclosed to or collected by third parties and may be used by others in ways we cannot control or predict, including to contact you for unauthorized purposes. By containing any information in the alerts, user is making the information public.

Blogs

The Site may offer publicly accessible blogs. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your Personal Information from our blog, contact us at Data Privacy Request Form. In some cases, we may not be able to remove your Personal Information, in which case we will let you know if we are unable to do so and why.

Testimonials

The Site may display personal testimonials in addition to other endorsements.

Our Site may enable you to post public comments, feedback, or reviews, through a Third Party Site. While the collection, use and disclosure of information you post on this Site is governed by this Privacy, personal testimonials posted publicly on a Third Party Site are also governed by that site's privacy policy. Except with your consent, we will share your Personal Information with third parties only in the ways that are described in this Privacy Policy. In certain instances you will have an opportunity to limit our uses at the time your Personal Information is collected or after by adjusting your account preferences. We will retain and use your information for as long as your account is active, or as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

We may share with service providers and sub-processors, involving onward transfer to help us and our Network provider our and the Network's respective services to you, as detailed below.

Communication

We, or our affiliates, may use your Personal Information to communicate with you, such as following up on your interest in receiving our Network's services, other services described on our Site, and/or if you express interest in potential employment with our Home Office.

Our Franchisees, Master Franchisees and affiliates may use your Personal Information to communicate with you, such as following up on your interest in receiving services and /or if you express interest in potential employment by our Franchisees or Master Franchisees.

Franchise Network

We may share your Personal Information with our independently owned and operated Franchisees and Master Franchisees and affiliates who are bound to protect such information from disclosure or misuse.

Service Providers

We may also share or disclose Personal Information to service providers to help us or the Network with our/its business activities, such as: offering customer service; assessing quality and customer satisfaction; enabling website features; providing research or analytics; developing advertising and marketing; providing enhanced care technology and services; or assisting with hiring of employees. These companies are generally subject to contractual restrictions on the use and retention of data, prohibited from selling your Personal Information, and authorized to use your Personal Information only as necessary to provide these services. Transfers to subsequent third parties are covered by the provisions in this Privacy Policy regarding Your Data Privacy Choices, the franchise agreements with our Franchisees and the master franchise agreements with our Master Franchisees.

Third Parties

We may use your Personal Information to provide you information about third-party businesses who offer products or services that we determine may be helpful to people who are or may be interested in the Network's services or resources.

We do not sell any Personal Information to marketing research or bulk advertising sales companies or to any other third parties. We may share your Personal Information with third parties, such as our service providers, but not in exchange for financial payment.

Legal Use

We may also disclose Personal Information in special cases when we have reason to believe that disclosing this Personal Information is necessary to identify, contact or bring legal action against someone who may have breached our Terms of Use or who may be causing (whether intentionally or unintentionally) injury to or interference with our rights or property, other website users, or anyone else who could be harmed by such activities.

We reserve the right to disclose your Personal Information to law-enforcement personnel and agencies when requested to do so, as required by law such as to comply with a subpoena, or if we are involved in a merger, acquisition, or sale of all or a portion of our assets.

At Home Instead, Inc., we respect your concerns about privacy and value the relationship we have with you. Like many companies, we use technology on our website to collect information that helps us enhance your experience and our products and services.

We and certain service providers operating on our behalf collect information about your activity, or activity on devices associated with you, on our Site using tracking technologies such as cookies, flash cookies, pixels, tags, scripts, software development kits, application program interfaces, and web beacons.

Independently owned and operated Home Instead franchise businesses may also utilize such technologies on the Site dedicated to their specific franchise. The franchise business is the controller of any such data collection and Home Instead, Inc. does not directly receive such data. Each franchise business is responsible for its data collection, use and disclosure; however, collection via the Site is subject to the terms and limitations of this privacy policy.

This tracking data may be used for many purposes including, for example, to:

• Provide useful features to simplify your experience when you return to or navigate our Site (for example, remembering the contact information you entered so you don't need to re-enter it)
• Deliver relevant content and advertising based on your preferences, usage patterns and location;
• Monitor, evaluate, and optimize the use and operation of our sites and applications; and
• Analyze traffic on our sites and on the sites of third parties.

We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.
